The President's Council on Bioethics has recently released a report supportive of the continued use of brain death as a criterion for human death. The Council's conclusions were based on a conception of life that stressed external work as the fundamental marker of organismic life. With respect to human life, it is spontaneous respiration in particular that indicates an ability to interact with the external environment, and so indicates the presence of life. Conversely, irreversible apnoea marks an inability to carry (...) out the necessary work of life, an inability which the Council considers an indicator of death. This conception has been conceived to circumvent criticisms of the previous model of loss of somatic integration, a model the Council admits that, in the presence of evidence of continuing functional integration in brain dead patients, was looking less than convincing. Nevertheless, by focusing on external work and ignoring the more essential work of integrative unity, the Council's conception of the nature of life is untenable, and of no assistance in supporting a relation of equivalence between the concepts of brain death and death. Consequently, the Council's conclusions do little to advance the definition of death debate, a potentially intractable debate that may necessitate the investigation of alternate ethical justifications for organ harvesting. We present a one per cent measurement of the cosmic distance scale from the detections of the baryon acoustic oscillations in the clustering of galaxies from the Baryon Oscillation Spectroscopic Survey, which is part of the Sloan Digital Sky Survey III. Our results come from the Data Release 11 sample, containing nearly one million galaxies and covering approximately 8500 square degrees and the redshift range 0.2 < z < 0.7. We also compare these results with those from the publicly released (...) DR9 and DR10 samples. Assuming a concordance Λ cold dark matter cosmological model, the DR11 sample covers a volume of 13 Gpc3 and is the largest region of the Universe ever surveyed at this density. We measure the correlation function and power spectrum, including density-field reconstruction of the BAO feature. The acoustic features are detected at a significance of over 7σ in both the correlation function and power spectrum. Fitting for the position of the acoustic features measures the distance relative to the sound horizon at the drag epoch, rd, which has a value of rd,fid = 149.28 Mpc in our fiducial cosmology. We find DV = at z = 0.32 and DV = at z = 0.57. At 1.0 per cent, this latter measure is the most precise distance constraint ever obtained from a galaxy survey. Separating the clustering along and transverse to the line of sight yields measurements at z = 0.57 of DA = and H =. Our measurements of the distance scale are in good agreement with previous BAO measurements and with the predictions from cosmic microwave background data for a spatially flat CDM model with a cosmological constant. © 2014 The Author Published by Oxford University Press on behalf of the Royal Astronomical Society. In The Agrarian Vision , Thompson argues that a better appreciation of agrarian ideals could lead to a more virtuous, more sustainable way of life. While I agree with Thompson in many respects, there are some aspects of the book that I question and others that I would like to hear Thompson explicate in greater detail. In this paper, I question Thompson’s claim that agrarian farmers and farming communities serve as ideal models of virtuous habits and good character. I challenge (...) Thompson’s use of virtue theory, particularly the notion that farming virtues can be acquired without participating in farming practices. In the end, I make the point that Thompson seems to vacillate between being realistic and being idealistic, which may seriously complicate our notions of responsibility and obligation in practice. Over the course of the last four decades, William Leon McBride has distinguished himself as one of the most esteemed and accomplished philosophers of his generation. This volume—which celebrates the occasion of his seventy-fifth birthday—includes contributions from colleagues, friends, and formers students and pays tribute to McBride’s considerable achievements as a teacher, mentor, and scholar.

As media reports have made widely known, in November 2009, the ethics committee of St. Joseph’s Hospital in Phoenix, Arizona, permitted the abortion of an eleven-week-old fetus in order to save the life of its mother. This woman was suffering from acute pulmonary hypertension, which her doctors judged would prove fatal for both her and her previable child. The ethics committee believed abortion to be permitted in this case under the so-called principle of double effect, but Thomas J. Olmsted, (...) the bishop of Phoenix, disagreed with the committee and pronounced its chair, Sister Margaret McBride, excommunicated latae sententiae, “by the very commission of the act.” In this article, I take the much discussed Phoenix case as an occasion to subject the principle of double effect to another round of philosophical scrutiny. In particular, I examine the third condition of the principle in its textbook formulation, namely, that the evil effect in question may not be the means to the good effect. My argument, in brief, is that the textbook formulation of the principle does not withstand philosophical scrutiny. Nevertheless, in the end, I do not claim that we should then “do away” with the principle altogether. Instead, we do well to understand it within the context of casuistry, the tradition of moral reasoning from which it issued. (shrink)

The “Phoenix Case” brought into public scrutiny a contemporary debate in Catholic moral theology over competing views on the relation of the object of the act to the physical structure of acts that arise from moral choices. A procedure that was described by hospital officials and their parent company as an indirect abortion was judged by the local ordinary, Bishop Thomas Olmsted, as a direct abortion. A debate ensued between Bishop Olmsted and Catholic Health Care West and their advisors. (...) Eventually, Bishop Olmsted excommunicated Sister Margaret Mary McBride for her role on the ethics committee approving the procedure and publicly announced his refusal to recognize the hospital as authentically Catholic. This author addresses the theological position of the hospital and addresses implications for other professionals in Catholic health care facing similar dilemmas. (shrink)

Cognitivism about trust says that it requires belief that the trusted is trustworthy; non-cognitivism denies this. At stake is how to make sense of the strong but competing intuitions that trust is an attitude that is evaluable both morally and rationally. In proposing that one's respect for another's agency may ground one's trusting beliefs, second-personal accounts provide a way to endorse both intuitions. They focus attention on the way that, in normal situations, it is the person whom I trust. My (...) task is to develop an account of the latter insight without the controversial theoretical commitments of the former. I propose a functional account for why the second and third-personal ‘systems’ operate not just in parallel, but in tandem, in support of a cognitivist account of trust. (shrink)

Codes of ethics are directly aimed at behavioral control, but they also affect a company’s ethical culture, which in turn concerns compliance and ethical behavior. To positively influence a company’s ethical culture, employees must be familiar with its code of ethics, perceive that top management is committed to the code, and believe that their peers also comply with the code. The evidence on whether a code’s design affects a company’s ethical culture is limited. This study’s factorial survey experiment contributes to (...) this gap in two ways: first, it investigates whether a code’s design affects how easily the code can be learned and, therefore, contributes to code familiarity. Second, it examines how a code can convey expectations regarding top management’s commitment and peers’ behavior, both of which are part of ethical culture. The results indicate that a positive tone increases code familiarity, and a code signed by top managers sends a strong signal of their commitment to the code. Finally, various implications of the results for research and practice are discussed. (shrink)

Hanks has defended a novel account of what propositions are. His key argument against Soames' rival view is that predication is not neutral. According to Hanks, predication is essentially committal. I show that Hanks' argument for this conclusion raises problems for his own account of questions and orders.

Horwich proposes a solution to the liar paradox that relies on a particular notion of grounding—one that, unlike Kripke’s notion of grounding, does not invoke any “Tarski-style compositional principles”. In this short note, we will formalize Horwich’s construction and argue that his solution to the liar paradox does not justify certain generalizations about truth that he endorses. We argue that this situation is not resolved even if one appeals to the \-rule. In the final section, we briefly discuss how Horwich (...) might respond to the situation. (shrink)

Morris, Assistant Professor of Philosophy at the University of Notre Dame, has written a technical yet provocative study on the Incarnation. As a faithful Christian he believes in and desires to defend the traditional Christian doctrine of the Incarnation proclaimed in the New Testament and defined (...) by the early councils of the Church, especially Chalcedon, that is, that Jesus is the One eternal Son existing in two natures. He also holds that, while the truth of the Incarnation is revealed, it must nonetheless stand the test of logic and reason. The Incarnation cannot be illogicaJ or meaningless. " If the church has been guided by God in such matters as the formulation of its creeds, conciliar decrees, and catechisms,.... we would not expect glaring logical flaws in its central doctrinal affirmations" (p. 46). The stated purpose of Morris's study is to defend the traditional doctrine against those who would hold it to be logically incoherent and meaningless. "In the course of thinking about the Incarnation for some years now, I have come to see that a few simple metaphysical distinctions and a solid dose of logical care will suffice to explicate and defend the doctrine against all extant criticisms of a philosophical nature" (p. 9). Morris meticulously analyzes and critiques a number of arguments that oppose the possibility of coherence of the Incarnation by attempting to demonstrate that such arguments are.either false and illogical themselves, or that they do not apply to a true understanding of the Incarnation. Moreover, Morris proposes a novel understanding of the Incarnation which he believes is both logical and intelligible, and which conforms to the Christian tradition. This goal of upholding the intelligibility of the Incarnate leads Morris to a three-fold task. He first of all must refute his chief adversaries, those who would deny the sensibleness of saying God became man in Jesus. Such critics deny the validity of the Incarnation on the ground..'! that it is meaning·less, and the'l'efore impossible to juxtapose the incommensurable. attributes of divinity and humanity, e.g., perfection/imperfection, immutability/corruptibility. They hold that Jesus could not have had both these sets of properties at once (cf. p. 20). Morris refuses to capitulate to such arguments. He nevertheless insists that any solution to the issue which would undermine human logic or which would fail to uphold the Christian's belief is no solution at all (cf. p. 32). 367 368 BOOK REVIEWS Secondly, Morris's task leads him to refute any attempts at a " OneNature " solution, which would "squash" together the human and divine natures in Jesus to form a single nature. Such proposals jeopardize either the integrity of Jesus's divinity (Arianism) or his humanity (Docetism, Monophysitism), inevitably composing a mythical tertium quid (cf. pp. 33-38). Morris presents a clear case against such corruptions of the Incarnation. Thirdly, Morris's task brings him to analyze contemporary kenotic Christology. He thoroughly discusses this approach, for the reason that it is directly involved in the issue at hand, namely, the incompatibility between divine and human properties in Christ. Secondarily, however, Morris's interest in kenoticism reflects his own hope that some variation of the approach might posibly arrive at a Christological solution (cf. p. 92). While he ultimately rejects kenoticism, Morris flirts with the various alternatives, and, as we shall see, his own perception of the Incarnation remains tinged with a kenotic flavor. How then is it possible to predicate of one and the same individual divine and human attributes intelligibly and coherentlyT To use contemporary computer jargon, the question might be phrased: is it possible that God and man can he "incarnation-friendly¥" Morris believes so. Morris first of all sets out to define the terms-divine nature and human nature. He believes part of the incompatibility problem lies in attributing to Jesus's humanity unnecessarily hostile aspects. This paper will examine the topic of identity in Roman Catholicism from the perspective of topics contained in or absent from mission statements of 25 Catholic health care institutions. In particular, I will look at these from the perspective of social justice as well as how this and other topics such as human dignity, the sanctity of life, stewardship, pastoral care and the likelihood of mergers with other institutions will affect the healing ministry of Catholic health care providers. The article (...) will conclude that there are three key dimensions to Catholic health care: leadership in advocating reform of the current health care system, care for the marginalized and under-insured, and the provision of pastoral care in all institutions. Christopher Cowley1has recently put forward three arguments against the legal accommodation of a general practitioner’s conscientious objection (CO) to abortion referrals.iHe claims that the adoption of these arguments does not undermine a more general right to CO to involvement in abortion. I argue that Cowley is seriously mistaken. His three arguments, especially the second and third, proceed on a path directed towards the outright rejection of a right to CO in healthcare contexts. A common problem with Cowley’s three arguments is (...) that they overlook the peremptory significance for CO analysis of both the internal, deliberating perspective of those with a CO and the good of moral integrity. This paper supports the view that either there are strong prima facie grounds for holding that a right to CO extends in principle to the issue of referrals or the claim of a general right to CO is easily assailable. Music teachers are often inclined to advocate the aesthetic value of music that is uncritically propagated by their conservatory training.1 Consequently, a host of misleading assumptions that music is a "fine" art that exists solely to promote aesthetic experience is simply taken for granted as the benefits of art and music education—thus ignoring the differences of purpose between school music and university-level training. Just offering routine musical activities and performances is thereby assumed to kindle students' aesthetic appreciation. American philosophy has been dominated by the theme of "Nature."1 From Edwards to Emerson to Dewey to Dennett, American thought has variously invoked Nature. But to articulate a philosophy of Nature is not thereby to espouse a form of "naturalism." In fact, philosophies undertaken in the name of "naturalism" seem to have a different temperament than those that begin with the thought of Nature as such. As a theme, "Nature" invites an expansive mood for reflection, while "naturalism" sounds constrictive and (...) combative. "Nature" disposes the mind to musement, "pondering," theoria, Denken—to becoming Emerson's "transparent eyeball." In this paper, I will to lay down what I call an expressivist account of the pragmatics of jokes, through which I wish to shed light on the function of offensive jokes in particular. I will focus specifically on jokes, not humor more generally. Jokes are particular sorts of speech-acts; and although many may be issued in the form of declarative or interrogative sentences, they are not reducible to them. I suggest here that their analysis must be understood in terms (...) of the unique pragmatic roles that they play. Following this I turn to offensive jokes in particular, describing some of the conditions relevant to their uptake. I will argue that there is a degree of entitlement to certain jokes, and set of commitments that follow from a given joke—both of which are necessary to understand the difference between a context in which a joke is offensive and one in which a similar joke may be merely not funny. I conclude by outlining how on my account we can understand the role of offensive humor as a mode of social criticism. (shrink)

Mnoge biološke funkcije dopuštaju stupnjevanje. Na primjer, lučenje određenog hormona u organizmu može biti na višoj ili nižoj razini, u usporedbi s istim organizmom drugom prilikom ili u usporedbi s drugim organizmima. Koje razine funkcioniranja predstavljaju slučajeve disfunkcije; gdje da povučemo crtu? To je kvantitativni problem za teorije disfunkcije i bolesti. Cilj mi je braniti verziju bioloških teorija disfunkcije kako bih se uhvatio u koštac s ovim problemom. Međutim, također ću dopustiti da evaluativna razmatranja uđu u teoriju bolesti. Moj argument (...) se temelji na razlikovanju između biološke i kliničke perspektive. Prema mom mišljenju, bolest je ograničena na slučajeve koji spadaju u granice bioloških disfunkcija. Odgovor na kvantitativni problem ne zahtijeva proizvoljne odluke ili društveno vrijednosne sudove. Stoga se zalažem za nearbitrarnu metodu koja se temelji na činjenicama kako bi se riješio kvantitativni problem. Ipak, nisu sve biološke disfunkcije instance bolesti. Dodavanje kliničke perspektive omogućuje nam da spriječimo potencijalnu preveliku uključenost biološke perspektive, zato što postavlja dodatna ograničenja za određivanje granica bolesti. (shrink)

ABSTRACTThe most publicised rebellion during the so-called ‘Shareholder Spring’ of 2012 was at Barclays PLC. Using multi-modal and critical discourse analysis, this paper examines how three UK television channels with different public service obligations covered this story on 27 April 2012. It finds that broadcasters’ regulatory obligations do not obviously impact content and that, for example, simple reporting routines contain judgemental phrases. Generally, the multi-dimensional nature of executive pay is simplified and the real balance between private and individual shareholders is (...) obscured. Analysis also reveals that editing and the use of images can subtly construct discourses that may not reflect the reality of the dissent. The paper concludes that established criticisms that business journalism is indolent and that corporate discourses are privileged are not supported, but also that the coverage contributes little to promote wider understanding of executive pay debates. Late in a career of more than sixty years, Thomas Burch, an internationally known social demographer, undertook a wide-ranging methodological critique of demography. This open access volume contains a selection of resulting papers, some previously unpublished, some published but not readily accessible [from past meetings of The International Union for the Scientific Study of Population and its research committees, or from other small conferences and seminars]. Rejecting the idea that demography is simply a branch of applied statistics, his work (...) views it as an autonomous and complete scientific discipline. When viewed from the perspective of modern philosophy of science, specifically the semantic or model-based school, demography is a balanced discipline, with a rich body of techniques and data, but also with more and better theories than generally recognized. As demonstrated in this book, some demographic techniques can also be seen as theoretical models, and some substantive/behavioral models, commonly rejected as theory because of inconsistent observations, are now seen as valuable theoretical models, for example demographic transition theory. This book shows how demography can build a strong theoretical edifice on its broad and deep empirical foundation by adoption of the model-based approach to science. But the full-fruits of this approach will require demographers to make greater use of computer modeling [both macro- and micro-simulation], in the statement and manipulation of theoretical ideas, as well as for numerical computation. Zoltan Jakab has presented an interesting conceptual analysis of the ineffability of qualia in a functionalist and classical cognitivist framework. But he does not want to commit himself to a certain metaphysical thesis on the ontology of consciousness or qualia. We believe that his strategy has yielded a number of highly relevant and interesting insights, but still suffers from some minor inconsistencies and a certain lack of phenomenological and empirical plausibility.
